Barry Smith murder trial: jury told majority verdicts will be accepted

THE jury in the Barry Smith murder trial has been told majority verdicts will now be accepted. Justice Charles Haddon-Cave QC said: "The jury was sent out at 1.05pm on Tuesday and have now been deliberating for nearly three days. By my calculations, they have been deliberating for 14-and-a-hours. "The law allows me to accept a verdict that is not the verdict of them all at some stage. It seems to me we are at that point." The judge previously told the jury "they and they only" will decide whether three people are guilty of murdering Barry Smith and if a fourth person is guilty of assisting an offender. Vincent Aitken, 44, of Chapel Street, Kilburn, his daughter Emma Aitken, 19, and her partner Nathan Doherty, 27, both of Portland Street, Derby, all deny the murder of Mr Smith. Pamela Aitken, 41, denies assisting an offender in relation to Mr Smith's death. Mr Smith's burnt body was discovered by two dog walkers outside Kilburn Welfare Social Club on October 6 last year. The prosecution say the 48-year-old was beaten to death with a fence post dragged to a pile of rubbish and his body set alight. Barry Smith was found dead outside Kilburn Welfare Social Club.
